A Contract

The Little Ones UK Ltd Terms and Conditions are a legally binding contract between the client or employer, herein after to be called the “Client,” and Little Ones UK Ltd herein after to be called the “Agency.”

A Client is a person or persons who approach the Agency either through written or verbal instruction and request that the Agency introduce the Client to a nanny; mother‘s help, maternity nurse or any person seeking domestic employment, hereinafter to be called the “Candidate,” for the purpose of employment.  

By registering with the Agency either verbally or through written instruction, and receiving Candidates for interview, the Client accepts the Agency’s Terms and Conditions.

B Rates and Fees

II    The Agency requires a £25 administration fee paid in advance of Client introductions to Candidates. This fee is deductable against the full placement fee. By paying this fee the Client has registered with the Agency.  

III   The Agency charges a standard fee for a permanent placement of 12% of the successful Candidates net annual salary – this is exclusive of VAT. The minimum fee for a permanent placement is £950 excluding VAT. Permanent placements outside of the United Kingdom will be charged at 18% of the successful Candidates net annual salary. Invoices raised within the European Union are subject to VAT. 

IV    Rates and Fees are payable by the Client within 7 (seven) days of the date of receipt of the invoice, which will be issued immediately after the Client has accepted either verbally or in writing a Candidate for employment. This must be strictly adhered to for the refund guarantee to apply.  

V     A surcharge of 25% will be added to all fees not settled in accordance with the Agency’s Terms and Conditions.

VI   Should the Candidate commence employment with the Client prior to the due date of the invoice, the Agency will require the full invoice to be paid in advance of the Candidates employment commencing. The Candidate will not commence employment prior to full settlement of the invoice. For overseas placements the full fee will be due prior to the Candidates departure to the Client’s country of residence. 

VII   Rates and Fees are due when a Candidate introduced by the Agency is offered and accepts employment with the Client, either by verbal or written agreement. If the position of employment is temporary and the Candidate returns to the Client within six months of the initial placement for further employment the Client is obliged to pay the Agency’s standard Rate or Fee for such a placement service. Should the original temporary employment be extended the Client is required to pay the difference between the Rate or Fee charged and the actual Fee that would have been charged for such a time period. 

VIII  Information communicated between the Agency and the Client, whether written or verbal, shall be confidential. The Client should not pass any information relating to any Candidate introduced by the Agency to a third party. Should the Client pass any such information on to a third party which results in the placement of a Candidate in any childcare position the Client will be liable to pay the Agency’s full respective Rate or Fee and these Terms and Conditions will apply for that placement.


C Platinum Service

I. The Agency offers a limited number of clients the option of accepting a “Platinum Service.” Clients must request this service specifically before the Client begins interviewing or chooses to employ a Candidate put forward by the Agency. If the Client wishes to become a Platinum Client the Client agrees to conduct their Candidate search solely through the Agency for a period of three calendar weeks.

II. If the Client employs a Candidate through an avenue or means aside from the Agency within the three week period from the start of their Platinum membership the Client agrees to pay the Agency an administration fee of £105 plus VAT.

III. By becoming a Platinum Client the Agency agrees to charge a fee of 10% of the Candidates net annual salary. Placements outside the United Kingdom will be charged at 16% of the Candidates net annual salary. A minimum fee of £950 plus VAT will apply to all permanent placements.

IV. If a Candidate placed by the Agency remains in the Clients employ for  fewer than six calendar months the Agency will replace the first Candidate placed with the Client once for no additional charge or fee.

V. The Agency, where possible, will provide the Client with temporary nannies and babysitters free of charge for the first six months of the permanent placement through the Agency.

N.B. Little Ones will strive to provide a Platinum Client with a temporary Candidate or babysitter but at very short notice this may prove beyond our means. For such instances the Agency accepts no responsibility or liability.

D Liability

The Agency shall not be liable under any circumstances for any loss, damage, expense, or compensation suffered or incurred by the Client either directly or indirectly arising from or in any way connected with the Agency introducing a Candidate or the Client employing a Candidate.

E Introduction of Candidates

The Agency endeavours to ensure but does not guarantee the suitability of any candidate introduced to the Client. The final decision to employ a candidate is the sole responsibility of the Client. The Client shall therefore satisfy themselves as to the suitability of the Candidate and the Client shall take up any references provided by the Candidate to it of the Agency before employing a Candidate. The Agency does not accept any liability for any inconvenience, damage or loss arising whether caused directly or indirectly from any act or omission of a Candidate introduced to the Client by the Agency.

The Agency offers no warranty for a Candidates character, honesty, reliability, suitability or capacity.

The Agency is not responsible for the Client and Candidates contract of employment. (This is to be arranged)These are to be arranged between the Client and Candidate. The Agency offers a contract of employment only as a guide for the Client. Under The Conduct of Employment Agencies and Employment Business Regulations 2003 effective April 6th 2004: All agencies will be required to hold a copy of the employment contract between employee and employer.

The Agency will not be liable for death or personal injury resulting from its negligence.

F Tax & National Insurance

It is the Client who is responsible for their employees Tax and National Insurance deductions.

G Interviewing Candidates

For the purpose of interview, the Client is responsible for a Candidates travelling expenses within reason. The Client shall settle this directly with the Candidate.
